Temporary Restraining Orders and Injunctions Against Harassment in Hawaiʻi

How a TRO Works in Hawaiʻi
In Hawaiʻi, a TRO can be obtained on an ex parte basis — meaning the accused is not present and has no opportunity to respond before the order is issued. A TRO can immediately remove a parent from the family home, restrict access to children, and create a presumption of dangerousness that follows the accused throughout a related proceeding.
Temporary Restraining Orders and Orders for Protection can be issued even when the defendant isn’t present in court and before a criminal matter has been finalized — in many cases, before the criminal process has really even begun. In essence, you can suffer certain consequences before a judge or jury has found you responsible for anything.

A temporary order becomes a long-term one only after a full hearing. That hearing is an evidentiary proceeding: exhibits are offered, witnesses testify, and the petitioner is subject to cross-examination. Preparation matters enormously.
