What His Experience Means for Clients

Criminal Defense

Brandon spent almost a decade as a Deputy Prosecuting Attorney for the County of Maui, and most of that time was spent in trial. He tried jury cases in Circuit Court, prosecuted felonies at every level, handled Family Court offenses, and worked the screening division, where he decided which cases would be charged and presented them to the grand jury. He later supervised the Vehicular Homicide and Traffic Safety Unit, which gave him responsibility for the most serious crash cases on Maui. People facing criminal charges benefit from that history directly. Brandon knows how a police report is written, how a prosecutor reads it, where an investigation tends to cut corners, and what actually moves a prosecutor to reduce or dismiss a charge. When a case cannot be resolved on fair terms, he is comfortable taking it in front of a jury, because he has done it many times.

Personal Injury

Before joining the prosecutor’s office, Brandon was a litigation associate at Alston Hunt Floyd & Ing, now Dentons, where he handled commercial and real property disputes in state and federal court. That work taught him to build a civil case from the ground up through written discovery, depositions, motion practice, and settlement conferences with well-funded opponents. He brings the same approach to personal injury cases. Insurance companies value claims based on what they expect a lawyer will be able to prove at trial, and Brandon prepares his clients’ cases with that in mind from the start. His years reviewing crash investigations as a traffic safety supervisor are especially useful in auto accident cases, where the scene evidence, reconstruction, and officer reports often decide who is found at fault.

Temporary Restraining Orders and Injunctions

Temporary restraining orders and injunctions move quickly, and the hearings are short, contested, and decided by a judge on the evidence presented that day. Brandon’s time in District Court and Family Court as a prosecutor involved hundreds of hearings of exactly that kind, many of them arising from the same family and neighbor disputes that lead to TRO petitions. He represents both people seeking protection and people who have been served with a petition, and he understands how a restraining order can affect a person’s housing, employment, firearms rights, and custody of their children. He prepares his clients to testify, gathers the documents and witnesses the judge will need, and cross-examines the other side with the skills he developed in criminal trials.

Appeals and the Trial Record

Brandon also clerked for the Chief Judge of the Hawaiʻi Intermediate Court of Appeals and worked in chambers at the Hawaiʻi Supreme Court and the U.S. District Court. Seeing how judges evaluate records and arguments shaped the way he tries cases. He preserves issues for appeal, writes briefs that judges can follow, and keeps a close eye on the record while a trial is in progress. Clients get a lawyer who has prosecuted cases, defended them, litigated against large firms, and helped judges decide them.

    Vehicular Homicide and Traffic Safety Unit Supervisor

    Handled all traffic-related felonies, supervised DPAs for OVUII and traffic-related offenses, and collaborated with local and state agencies on traffic safety-related policy and legislation.

    Circuit Court / Family Court Deputy

    Responsible for jury trials and prosecuting all classes of felony offenses, adult Family Court offenses, and jury-demand misdemeanor trials. Also handled juvenile prosecution, Circuit Court mental health calendar, HRPP Rule 40 cases, and appeals.

    Felony Screening Division

    Handled case screening, investigation, information charging, preliminary hearing, and grand jury proceedings for all felony-level offenses.

    District Court Supervisor

    Supervised DPAs in District Court, managed the mental health calendar, trained law enforcement on legal issues, and collaborated with local and state agencies on District Court policy and legislation.

    District Court Deputy

    Prosecuted traffic offenses, violations, petty misdemeanors, and misdemeanor bench trials. Handled Environmental Court and outer-district Courts.

Alston Hunt Floyd & Ing (now known as Dentons) — Associate Attorney

Practice concentrated on commercial and real property litigation. Work included discovery, depositions, legal research and briefing, and appearances before Hawaiʻi District Courts, Hawaiʻi Circuit Courts and Federal U.S. District Court for pre-trial, contested and dispositive motions, and settlement conferences. Other work included appellate briefing before the Hawaiʻi appellate courts and U.S. Court of Appeals for the Ninth Circuit, adversarial bankruptcy actions, and creditor rights.
