How a Serious Collision Case Is Actually Proven

In a minor collision, liability is usually obvious and the argument is about the value of the injuries. In a serious one it is often the opposite: the insurer disputes how the crash happened at all. Speed, braking, right of way, sight lines, the sequence of impacts, whether a vehicle could have stopped in time — these are contested with evidence, not with narrative.

Before entering private practice, Brandon Segal supervised the Vehicular Homicide and Traffic Safety Unit as a Deputy Prosecuting Attorney for the County of Maui. Those are the most technically demanding collision cases there are: fatalities and serious injuries proven through accident reconstruction, scene measurements, vehicle crash data, toxicology and expert testimony, and tried to verdict against experienced defense counsel.

That is the same evidence that decides a civil injury claim, examined to a criminal standard of proof. A reconstruction report from the other side is read here by someone who has commissioned them, relied on them, and seen them tested under cross-examination — which is also what tells us when it is worth retaining our own expert rather than conceding the point.

Insurers also evaluate a claim partly on who is presenting it. A file handled by an attorney who appears in court regularly, and who has prepared collision cases for trial, is assessed differently from one the adjuster expects will settle for whatever is offered. We prepare these matters as though they will be tried — which is often what makes trying them unnecessary.
